Parties

In this agreement, all references to ‘Dynamic Wealth’ include all entities within the Dynamic Wealth Group.

Acceptance

These conditions become effective when you access the site for the first time and constitute a binding agreement between us (Dynamic Wealth) and yourself, which will always prevail. The current version of these conditions will govern our respective rights and obligations each time you access this site.

Disclaimer and limitation of liability

Use of this site and the online services is entirely at the user's own risk. The user assumes full responsibility for the risk or loss resulting from the use of this site and the user's reliance on information contained on it.
In no event will Dynamic Wealth be liable for any damages, whether direct, indirect, special, incidental, or consequential whatsoever relating to the user's use of this site or the online services or the information contained on this site or the user's inability to use this site or the online services, whether such damages arose out of contract, or delict or otherwise and regardless of whether Dynamic Wealth was expressly advised of the possibility of such loss or damage.

Without derogating from the generality of the above, and to the extent legally permitted, Dynamic Wealth will not be liable for:

any interruption, malfunction, downtime, offline situation or other failure of the site or online services, Dynamic Wealth’s system, databases or any of its components, beyond Dynamic Wealth’s reasonable control;
any loss or damage with regard to the users’ data or other data directly or indirectly caused by malfunction of Dynamic Wealth’s system, third party systems, power failures, unlawful access to or theft of data, computer viruses or destructive code on Dynamic Wealth’s system or third party systems or programming defects;
any interruption, malfunction, downtime or other failure of goods or services provided by third parties, including, without limitation, third party systems such as the public switched telecommunication service providers, internet service providers, electricity suppliers, local authorities and certification authorities, or any event over which we have no direct control.

Offer

No information or content contained on these pages should be construed as an offer by Dynamic Wealth. All services offered by Dynamic Wealth are subject to signature of the requisite application forms and other documentation relating thereto and are governed by the standard terms and conditions of Dynamic Wealth in respect thereof and Dynamic Wealth shall not be bound in any manner until a formal written agreement has been entered into. Dynamic Wealth reserves the right to reject in its discretion any application submitted for services contained on this website.

Transmission of Information

Your attention is drawn to the fact that information transmitted via the Internet, including without limitation e-mail, is susceptible to monitoring and interception. You are therefore discouraged from transmitting to Dynamic Wealth any information which may be confidential, proprietary or sensitive. You shall bear all risk of transmitting such information in this manner and under no circumstances will Dynamic Wealth be liable for any loss, harm or damage suffered by you as a result thereof. Dynamic Wealth reserves the right to request independent verification of any information transmitted via e-mail and you consent to such verification should Dynamic Wealth deem it necessary.
Dynamic Wealth requests that no unsolicited confidential or proprietary information be sent to Dynamic Wealth. Any such unsolicited information or material sent to Dynamic Wealth will be deemed not to be confidential, unless otherwise agreed in writing by Dynamic Wealth. Notwithstanding the aforegoing, Dynamic Wealth will not sell or forward any personal user information to any third party unless obliged to do so by law.

Services Online

Dynamic Wealth’s online services are subject to registration and approval, which Dynamic Wealth may accept or reject at its sole discretion.

Amendments to these conditions

We may amend these conditions from time to time. By accessing this site, you are bound to the version of the conditions published here at the time of any visit to this site. You agree to view the current version each time you access the site.

A certificate signed by the administrator responsible for maintaining this site will be prima facie proof of the date of publication and content of the current version and all previous versions of the conditions.

General Provisions

The headings of the clauses in the conditions are provided for convenience and ease of reference only and will not be used to interpret, modify or amplify the terms of the conditions.

Where any dates or times need to be calculated in terms of the conditions, the international standard time: GMT plus two hours shall be used.

No failure or delay by us to exercise any of our rights will be construed as a waiver of any such right, whether this is done expressly or implied, nor will it affect the validity of any part these conditions or prejudice our right to take subsequent action against you.

If any of these terms, conditions or provisions are held to be invalid, unlawful or unenforceable; the term, condition or provision will be deleted from the remaining terms, conditions and provisions which will continue to be valid to the full extent permitted by law.

User's liability to Dynamic Wealth

The user shall be liable to Dynamic Wealth for any liabilities, losses or expenses incurred by Dynamic Wealth as a result of any breach by the user of these terms and conditions.

Enforceability

If any of the foregoing is not fully enforceable for any reason, the remainder shall nonetheless continue to apply.

Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of South Africa in respect of any disputes arising in connection with the services referred to herein, or these terms and conditions or any matter related to or in connection therewith.
